HARARE - A Harare-based funeral parlour is facing eviction after failing to pay $53 000 owed to Mining Industry Pension Fund (MIPF) in rentals since May last year.
According to court summons, Nuffield Funeral Home (Private) Limited, currently operating from Tafara Building at number 58 George Silundika Avenue in Harare, entered into a lease agreement with MIPF in May last year.
The funeral parlour was supposed to pay $3 800 every month in rentals.
“Further, defendant (Nuffield) also undertook to pay plaintiff (MIPF) collection commission and costs of suit on the legal practitioner and client scale in the event of breaching the lease agreement and plaintiff having to institute legal proceedings to assert its rights,” part of the court papers reads.
MIPF, through its lawyer Kudzayi Erick Kadzere from Kadzere, Hungwe and Mandevere law firm, said Nuffield breached the contract by failing to pay its rentals.
The organisation claims Nuffield owes it $30 833, 64 in respect of rent and $22 403, 99 for operating costs.
According to court papers, MIPF has sought to cancel the lease agreement and demanded that Nuffield vacate the premises and that it pays all the outstanding arrears.
However, the organisation claims Nuffield has refused to vacate the premises and failed to pay the money.
MIPF is now seeking a High Court order for the cancellation of the lease agreement and the funeral parlour’s ejectment from the premises.
The funeral parlour has not yet responded to the application, which is still to be given a set down date at the High Court.
